Elon Musk Loses Lawsuit Against OpenAI

Elon Musk’s legal challenge against OpenAI and Sam Altman has collapsed after a California jury unanimously ruled that the case had been filed too late for the claims to proceed.

The lawsuit centred on OpenAI’s shift from its original non-profit structure into a more commercially driven artificial intelligence company. Musk argued that Altman moved away from the organisation’s founding mission after securing early financial backing, including Musk’s reported $38 million (£28.5 million) contribution during OpenAI’s early development.

According to Musk, OpenAI originally presented itself as a non-profit initiative focused on developing artificial intelligence for the benefit of humanity rather than commercial gain. He claimed the company later abandoned that position as ChatGPT and other AI products became commercially successful.

Focus on OpenAI’s Commercial Change

The case became one of the most closely watched disputes in the AI sector, drawing attention to the growing tensions surrounding control, governance, and profit structures inside major artificial intelligence companies.

Jurors spent nearly three weeks reviewing internal communications and hearing testimony from senior technology executives, including Musk, Altman, and Microsoft chief executive Satya Nadella. Despite the lengthy proceedings, the jury reportedly reached its decision in around two hours.

Musk had also accused Microsoft of helping OpenAI transition into a more profit-oriented structure through its multibillion-dollar partnership and continued investment in the company. The ruling adds another escalation in the increasingly public divide between Musk and OpenAI, as competition in the global artificial intelligence industry continues to intensify.
