Terraform Labs Files for Chapter 11 Bankruptcy

Terraform Labs, the company behind digital assets TerraUSD (UST) and Luna, has officially filed for Chapter 11 bankruptcy in Delaware. This strategic move is aimed at facilitating the continuation of its operations and supporting ongoing litigation in Singapore and the United States, particularly involving the Securities and Exchange Commission (SEC). The Chapter 11 filing also assures that all financial commitments to employees and vendors will be met without the need for additional financing.
Court documents reveal that Terraform Labs’ estimated assets and liabilities fall within the range of $100 million to $500 million, with the number of creditors ranging between 100 and 199. Despite the challenges faced, the company expresses its commitment to expanding its web3 business, evidenced by recent acquisitions like Pulsar Finance and the launch of Station v3, a cryptocurrency wallet.
The bankruptcy filing comes on the heels of the SEC’s decision to delay the civil trial against Terraform Labs and co-founder Do Kwon, who is currently in custody in Montenegro. The trial, originally scheduled for January 29, has been postponed to March 25. Kwon faces potential extradition to the U.S. or South Korea after the final ruling in March, with the extradition decision resting with Montenegro’s justice minister.
Terraform Labs, founded in 2018, experienced a significant collapse in May 2022, erasing over $40 billion in market value and impacting the broader cryptocurrency industry. The SEC had charged Kwon and Terraform Labs in February of the previous year, alleging cryptocurrency fraud related to the digital assets Terra USD and Luna. Kwon, holding a 92% stake in Terraform Labs, is central to the legal proceedings, while co-founder Daniel Shin holds an 8% stake in the company, as indicated in the court filing.
